Plain English

Section 410.950 of 105 CMR 410.000 is a severability clause, meaning that if any single part of the Massachusetts Sanitary Code's minimum housing standards regulations is found legally invalid by a court or authority, that finding does not invalidate the rest of the regulations. The remaining provisions of 105 CMR 410.000 continue to operate with full legal force. This is a standard structural safeguard built into the regulatory framework itself.

For Property Managers

Under § 410.950, the entirety of 105 CMR 410.000 does not stand or fall as a single unit — each provision is legally independent. Compliant property operators can rely on the fact that the bulk of the Sanitary Code's housing standards remain enforceable even if a specific subsection were ever successfully challenged. Staying current with all applicable requirements under 105 CMR 410.000 remains the standard practice regardless of any legal challenges to individual provisions.

For Tenants

Section 410.950 ensures that tenants retain the protections of 105 CMR 410.000 as a whole, even if a particular provision within the code is ever struck down. Rights and remedies available under other sections of the Sanitary Code — such as the ability to report violations to a local board of health or raise a code violation as a defense in a housing proceeding — are not undermined by a challenge to any single part of the regulations. Tenant-rights organizations can help explain which specific provisions of 105 CMR 410.000 apply to a given housing situation.
