Code Regs. 460.200, enacted pursuant to M.G.L. c. 111, § 196, Massachusetts law broadly prohibits the application of lead-based paint or similar lead-containing substances to dwellings, furniture, toys, and food-related items. The rule also bars the sale, distribution, or possession-with-intent-to-distribute any items coated with such substances, as well as the sale or distribution of lead-based paint or surface coverings themselves. Limited exemptions to the prohibition on selling lead-based paint products may be granted by the Director under 105 CMR 460.300.

Property owners and managers operating under Massachusetts law should be aware that 105 Mass. Code Regs. 460.200 makes it unlawful to apply lead-based paint or lead-containing glazes to any interior or exterior surface or fixture of a dwelling. Compliant operators ensure that no renovation, maintenance, or decorating work on their properties involves the use of lead-based paints or coatings, and they verify that contractors working on their properties follow the same standard. Familiarity with the exemption process outlined in 105 CMR 460.300 is relevant for any operator who believes a specific product or situation may qualify for Director-granted relief.

Tenants in Massachusetts are protected by 105 Mass. Code Regs. 460.200, which makes it illegal for any person—including a landlord or their agents—to apply lead-based paint or lead-containing substances to surfaces inside or outside a dwelling. If a tenant believes this provision has been violated, general enforcement paths include filing a complaint with the local board of health or the Massachusetts Department of Public Health, which administers the lead paint program under M.G.L. c. 111, § 196. Tenant-rights organizations can help residents understand what documentation to gather and what local or state agencies may be relevant to their situation.
