Cal. Civ. Code § 6.02
Applicability
Operative Text
(1) 760 CMR 6.00 applies to all persons residing in state aided public housing, known as c. 200
family housing, c. 667 elderly/disabled housing and c. 705 family housing, except as otherwise
provided and further provided that persons residing in housing units receiving federal Section
8 subsidy shall have their rents determined in accordance with applicable federal Section 8
regulations. 760 CMR 6.00 also applies to those persons residing in state aided public housing,
known as c. 689 special needs housing, provided that the housing is under the direct management
of an LHA and Residents have individual leases with the LHA. 760 CMR 6.07 applies only to
Residents in c. 667 elderly/disabled housing.
(2) 760 CMR 6.05 and 6.08 apply to participants in the Alternative Housing Voucher Program
(AHVP). See 760 CMR 53.00: Alternative Housing Voucher Program. 760 CMR 6.08 applies
to participants in the Massachusetts Rental Voucher Program (MRVP). See 760 CMR 49.00:
Massachusetts Rental Voucher Program.Section 760 CMR 6.02 defines the scope of the Massachusetts public housing rent regulations found in 760 CMR 6.00. The rules generally cover residents of state-aided public housing programs—including Chapter 200 family housing, Chapter 667 elderly/disabled housing, Chapter 705 family housing, and Chapter 689 special needs housing under direct Local Housing Authority (LHA) management—but residents whose units receive federal Section 8 subsidies have their rents set by federal rules instead. Certain subsections apply more narrowly: 760 CMR 6.07 is limited to Chapter 667 elderly/disabled residents, while 760 CMR 6.05 and 6.08 extend to participants in the Alternative Housing Voucher Program (AHVP) and the Massachusetts Rental Voucher Program (MRVP).
Plain English — not legal advice.
Local Housing Authorities (LHAs) operating state-aided public housing should use 760 CMR 6.02 as the starting point for determining which rent rules govern each resident. Compliant LHAs identify whether a household falls under a Chapter 200, 667, 705, or 689 program, confirm whether a federal Section 8 subsidy applies (which would trigger federal rather than state rent rules), and apply the correct subsections—such as 760 CMR 6.07 for elderly/disabled housing or 760 CMR 6.08 for MRVP participants—accordingly. Maintaining accurate program-type records for each unit helps ensure the right regulatory framework is applied consistently.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
If you live in Massachusetts state-aided public housing, 760 CMR 6.02 determines which rent rules apply to your household based on your housing program type. Residents in Chapter 667 elderly/disabled housing have additional protections under 760 CMR 6.07, while those participating in the AHVP or MRVP should look to 760 CMR 6.05 and 6.08 for relevant provisions. If you believe the wrong rent framework is being applied to your unit—for example, if your LHA is using state rules when a federal Section 8 subsidy should govern—you may consider contacting your LHA directly, reaching out to a local tenant-rights organization, or consulting the Massachusetts Department of Housing and Community Development for guidance.
