Cal. Civ. Code § 6.10
Waiver Provision
Operative Text
An LHA may submit to EOHLC for approval a request for waiver from the provisions in
760 CMR 6.00. The LHA shall consult with the LTO(s) prior to submitting any such request to
EOHLC. With any request for waiver the LHA shall submit to EOHLC a detailed written
statement setting out why the waiver is needed and the benefit(s) anticipated from the waiver.
The LHA shall provide a copy of the request for waiver with any supporting documentation to
the LTO in a matter affecting the rights, status, or duties of Residents. Within 30 days, any
affected LTO may submit to EOHLC a detailed written statement why a requested waiver should
be denied. EOHLC, in its discretion may approve a waiver if it determines that good cause exists
for the waiver which will likely have significant benefit and will likely serve a public purpose.
760 CMR 6.00: M.G.L. c. 23B; c. 121B, §§ 29, and 32, St. 1989, c. 151.Section 760 CMR 6.00 § 6.10 establishes a formal process by which a Local Housing Authority (LHA) may seek an exemption from the requirements set out in 760 CMR 6.00. The LHA must consult with Local Tenant Organizations (LTOs) before applying, submit a detailed written justification to the Executive Office of Housing and Livable Communities (EOHLC), and share all supporting materials with affected LTOs. Affected LTOs then have 30 days to file a written objection with EOHLC. EOHLC retains discretionary authority to approve a waiver only upon finding good cause, significant anticipated benefit, and a public purpose served by the exemption.
Plain English — not legal advice.
Under 760 CMR 6.00 § 6.10, an LHA seeking a waiver from any provision of 760 CMR 6.00 is generally expected to begin by consulting with the relevant LTO(s) before any formal submission is made to EOHLC. The waiver request package submitted to EOHLC typically includes a detailed written statement explaining the need for the waiver and the anticipated benefits, along with copies of all supporting documentation provided to the LTO. Compliant LHAs ensure that LTOs whose residents' rights, status, or duties may be affected receive the full request package in a timely manner so the 30-day response window can run properly.

Section 760 CMR 6.00 § 6.10 gives Local Tenant Organizations a meaningful role in the waiver process: when an LHA requests an exemption from 760 CMR 6.00 that could affect residents' rights, status, or duties, the LTO must receive a copy of the full request and supporting documentation. Within 30 days of receiving that material, an affected LTO may submit a detailed written statement to EOHLC explaining why the waiver should be denied. Residents who believe a pending waiver affects their rights may wish to contact their LTO, review the submitted materials, or reach out to a tenant-rights organization for general information about participating in the EOHLC review process.
