Mich. Comp. Laws § § 37.2705
Construction of act.
Operative Text
Sec. 705. (1) This act shall not be construed as preventing the commission from securing civil rights guaranteed by law other than the civil rights set forth in this act. (2) This act shall not be interpreted as restricting the implementation of approved plans, programs, or services to eliminate discrimination and the effects thereof when appropriate. (3) This act shall not be interpreted as invalidating any other act that provides programs or services for persons covered by this act.
Michigan Civil Rights Act § 37.2705 is a savings and construction clause that clarifies the scope of the broader Elliott-Larsen Civil Rights Act (MCL § 37.2101 et seq.). It establishes that the Act does not limit the Michigan Civil Rights Commission's authority to pursue civil rights protections beyond those explicitly listed in the Act, does not prevent the implementation of approved anti-discrimination programs or remedial plans, and does not override or invalidate other laws that provide services or protections to covered individuals. In short, this provision ensures the Act works alongside—rather than in conflict with—other civil rights frameworks.
Plain English — not legal advice.
Property owners and managers operating under Michigan law should understand that § 37.2705 means compliance with the Elliott-Larsen Civil Rights Act does not exhaust their obligations—other state or local anti-discrimination laws, programs, or approved remedial plans may independently apply to their operations. Compliant operators generally stay informed about overlapping civil rights requirements at the state and local level, recognizing that the Michigan Civil Rights Commission retains broad authority beyond the Act's enumerated provisions. Reviewing applicable fair housing programs and any approved remedial plans in the relevant jurisdiction is a standard part of responsible property management in Michigan.

Section 37.2705 of MCL § 37.2101 et seq. affirms that tenants retain civil rights protections beyond what is explicitly written in the Elliott-Larsen Civil Rights Act itself, including rights secured through other state laws, local ordinances, or approved anti-discrimination programs. This means that if a tenant believes their rights have been violated, there may be multiple legal frameworks and remedies available, not just those enumerated in the Act. Tenants who believe they have experienced housing discrimination may consider contacting the Michigan Civil Rights Commission, a local fair housing organization, or a tenant-rights group to understand the full range of protections that may apply under § 37.2705 and related laws.
