Mich. Comp. Laws § § 125.533
Compliance by owner and occupant.
Operative Text
Sec. 133. (1) The owner of premises regulated by this act shall comply with all applicable provisions of the act. (2) The occupant of premises regulated by this act shall comply with provisions of the act specifically applicable to him.
Michigan Compiled Laws § 125.533 establishes a dual compliance obligation under the state's housing law: property owners must follow all applicable provisions of the act, while occupants are required to comply only with those provisions that specifically apply to them. The rule draws a clear distinction between the broader duties placed on owners and the narrower, role-specific duties placed on occupants. Neither party is exempt from the portions of the act that govern their respective role in the housing relationship.
Plain English — not legal advice.
Under MCL § 125.533, property owners bear the more comprehensive compliance burden — they are responsible for meeting all applicable requirements of the act, not just those that pertain to a particular situation. Compliant operators generally conduct regular reviews of their properties against the full scope of the act's requirements and maintain documentation showing ongoing adherence. Because the owner's obligation is broader than the occupant's, operators typically do not rely on tenant conduct as a substitute for their own compliance duties.

MCL § 125.533 makes clear that occupants are responsible for complying with the provisions of the act that are specifically directed at them, which is a narrower set of obligations than what owners must meet. Tenants who believe an owner is failing to meet the owner-specific requirements of the act may have grounds to raise that failure as a relevant issue in housing proceedings or complaints. Tenant-rights organizations and local housing agencies can help occupants understand which provisions of the act apply to them and what options may be available when compliance issues arise.
