Mich. Comp. Laws § § 554.606
Waiving requirements of act.
Operative Text
Sec. 6. The requirements of this act may not be waived by the parties to a rental agreement except as specifically provided herein.
Under MCL § 554.606, the protections and requirements established by Michigan's rental agreement statute are not something that landlords and tenants can simply agree to set aside. The law's provisions remain in force regardless of what a lease or other agreement between the parties might say to the contrary. Only those specific exceptions that the statute itself identifies are permitted.
Plain English — not legal advice.
MCL § 554.606 means that lease clauses attempting to waive the requirements of the Michigan rental agreement act are generally unenforceable, even if a tenant signs them. Compliant operators review their lease agreements to ensure no provisions purport to disclaim or override statutory obligations. Staying current with the specific exceptions the act does allow helps ensure lease terms hold up if challenged.

MCL § 554.606 provides that a landlord cannot use a lease clause to strip away the rights the Michigan rental agreement act grants you — your signature on such a clause does not make it binding. If a lease contains language that appears to waive statutory protections, that language may be unenforceable under this provision. Tenant-rights organizations can help you understand which protections apply and what avenues — such as raising a statutory violation as a defense in a court proceeding — may be available.
