Rule 709. (1) The community does not have to maintain its internal roads, walkways, driveways, and permanent foundations free of cracks, but the community shall maintain its internal roads, walkways, driveways, and permanent foundations in a sound condition reasonably free of all of the following: (a) Holes. (b) Upheavals. (c) Buckling. (d) Depressions. (e) Rutting or channeling of the wearing surface. (f) Shifting of the driving or walking surface or foundation base and subbase. (g) Improper grading. (2) The community shall maintain all of its internal roads serving licensed and occupied home sites in a passable condition. History: 1985 AACS; 1991 AACS; 1998 AACS.
Under Mich. Admin. Code R. 125.1709, manufactured housing communities are not required to keep internal roads, walkways, driveways, and permanent foundations completely free of cracks, but they must keep these surfaces in a sound condition free of specific hazards — including holes, upheavals, buckling, depressions, rutting, surface shifting, and improper grading. Additionally, all internal roads serving licensed and occupied home sites must be kept in a passable condition at all times. The rule draws a clear line between cosmetic imperfections, which are tolerated, and structural or safety deficiencies, which are not.
Plain English — not legal advice.
Community operators subject to R. 125.1709 generally conduct routine inspections of internal roads, walkways, driveways, and permanent foundations to identify and address conditions such as holes, upheavals, buckling, depressions, rutting, surface shifting, and improper grading before they become compliance issues. While surface cracking alone does not trigger a violation, roads serving licensed and occupied home sites must remain passable, meaning access cannot be allowed to deteriorate to the point of obstruction or unsafe travel. Maintaining documentation of inspection schedules and repair activities is a common practice among operators seeking to demonstrate ongoing compliance with this rule.

Residents of manufactured housing communities have a right under R. 125.1709 to internal roads, walkways, driveways, and permanent foundations that are free of hazards such as holes, upheavals, buckling, depressions, rutting, surface shifting, and improper grading, and to roads that remain passable. If a community's infrastructure appears to fall short of these standards, tenants may consider documenting the conditions with photographs and dates, and reporting concerns to the Michigan Department of Licensing and Regulatory Affairs, which oversees manufactured housing community compliance. Tenant-rights organizations familiar with Michigan manufactured housing law can help residents understand what options may be available, including how to raise a violation through appropriate administrative channels.
