Mich. Comp. Laws § § 125.1444e
Income eligibility standards applicable to tenant of housing project.
Operative Text
Sec. 44e. Income eligibility standards applicable to a tenant of a housing project financed under this act shall be complied with at the time of the initial occupancy of the tenant. The authority shall require subsequent compliance with income eligibility standards by an initially eligible tenant only to the extent that the authority determines that compliance is necessary or desirable to effectuate the purposes of this act or applicable federal law.
Under MCL § 125.1444e et seq., income eligibility requirements for tenants in housing projects financed under Michigan's housing finance law apply at the point a tenant first moves in. After that initial check, the governing authority has discretion to decide whether ongoing income compliance reviews are necessary or desirable to fulfill the law's purposes or applicable federal requirements — meaning continued income monitoring is not automatically mandatory for tenants who were eligible when they first occupied a unit.
Plain English — not legal advice.
For operators of housing projects financed under this act, MCL § 125.1444e et seq. means that a thorough income eligibility screening at the time of initial occupancy is the primary compliance obligation. Compliant operators document that each incoming tenant met the applicable income standards at move-in. Any subsequent income recertification requirements would come only if the Michigan State Housing Development Authority determines such reviews are necessary, so operators generally monitor guidance from the authority to understand whether post-occupancy income checks apply to their specific program.

MCL § 125.1444e et seq. establishes that your income is evaluated for eligibility when you first move into a qualifying housing project — not necessarily on a rolling basis thereafter. If you were income-eligible at initial occupancy, you generally retain your tenancy unless the authority has specifically determined that ongoing compliance reviews are required for your program. Tenants who have questions about whether additional income reviews apply to their situation may wish to contact the Michigan State Housing Development Authority directly or consult a tenant-rights organization familiar with state housing finance programs.
