Section 601 of Michigan's Elliott-Larsen Civil Rights Act (MCL § 37.1601) designates the Michigan Civil Rights Commission as the body responsible for overseeing and administering the act. The Commission is also granted authority to create formal rules—through the state's Administrative Procedures Act—that help implement and enforce the act's requirements. This provision establishes the institutional framework under which civil rights protections in housing and other areas are carried out in Michigan.

For Property Managers

Under MCL § 37.1601, property owners and managers operating in Michigan should be aware that the Michigan Civil Rights Commission holds administrative authority over the Elliott-Larsen Civil Rights Act, including its housing provisions. Compliant operators generally stay informed of any rules or guidance the Commission promulgates under this authority, as those rules carry the force of law. Monitoring official Commission publications and rulemaking notices is a common practice for operators seeking to remain in compliance.

For Tenants

MCL § 37.1601 establishes that the Michigan Civil Rights Commission is the agency responsible for administering the civil rights protections that apply to housing in Michigan. Tenants who believe their rights under the Elliott-Larsen Civil Rights Act have been violated may look to the Commission as a starting point, as it holds the authority to enforce the act and issue implementing rules. Tenant-rights organizations and legal aid services familiar with Michigan civil rights law can help individuals understand how the Commission's rules and processes may apply to their circumstances.
