Minn. R. 4761 § 4761.2590
AMENDING NOTIFICATIONS.
Operative Text
A. A certified lead firm, lead supervisor, or property owner performing lead hazard reduction must submit to the commissioner an amendment, on a form provided by the commissioner, for any change in the information reported to the commissioner on the original notice under part 4761.2580 or any subsequent amendment received after the original notice. B. All amendments, except for changes in work shift times and dates, must be in writing, via mail, delivery, facsimile, or on an electronic format provided by the commissioner, with the changes clearly indicated. C. Amendments to the work dates and shift times must be telephoned, faxed, mailed, delivered, or electronically submitted to the commissioner. D. The commissioner must receive all amendments at the time it is determined the information on the notification will change.
Minnesota Rule 4761 § 4761.2590 governs how changes to lead hazard reduction work notifications must be communicated to the state commissioner. When any information on an original notice (filed under Minn. R. 4761 § 4761.2580) or a prior amendment changes, an updated amendment must be submitted using a commissioner-provided form. Most changes must be submitted in writing through mail, delivery, fax, or an approved electronic format, while changes to work dates and shift times may also be communicated by phone. Amendments must reach the commissioner as soon as it becomes known that the original notification information will change.
Plain English — not legal advice.
Property owners performing lead hazard reduction work are directly subject to Minn. R. 4761 § 4761.2590 and are responsible for keeping the commissioner informed of any changes to previously submitted notification details. Compliant operators typically maintain close oversight of project schedules and personnel so that amendments can be submitted promptly the moment a change is identified, using the commissioner's designated form and an approved submission method. For most changes, written submission via mail, fax, delivery, or electronic format is required, though shifts in work dates or times may also be reported by phone.

Minn. R. 4761 § 4761.2590 establishes that tenants living in properties undergoing lead hazard reduction work benefit from a system requiring the responsible party—whether a certified lead firm, supervisor, or property owner—to keep state authorities updated on any changes to the work plan. If a tenant believes that changes to lead hazard reduction work at their property were not properly reported to the commissioner, they may consider contacting the Minnesota Department of Health or a local tenant-rights organization to understand available options. Staying informed about the original notification filed under Minn. R. 4761 § 4761.2580 and any amendments can help tenants monitor whether work is being conducted as reported to the state.
