Cal. Civ. Code § 213.065
Discrimination in public accommodations prohibited, exceptions
Operative Text
1. All persons within the jurisdiction of the state of Missouri are free and equal and shall be entitled to the full and equal use and enjoyment within this state of any place of public accommodation, as hereinafter defined, without discrimination or segregation because of race, color, religion, national origin, sex, ancestry, or disability. 2. It is an unlawful discriminatory practice for any person, directly or indirectly, to refuse, withhold from or deny any other person, or to attempt to refuse, withhold from or deny any other person, any of the accommodations, advantages, facilities, services, or privileges made available in any place of public accommodation, as defined in section 213.010 and this section, or to segregate or discriminate against any such person in the use thereof because of race, color, religion, national origin, sex, ancestry, or disability. 3. The provisions of this section shall not apply to a private club, a place of accommodation owned by or operated on behalf of a religious corporation, association or society, or other establishment which is not in fact open to the public, unless the facilities of such establishments are made available to the customers or patrons of a place of public accommodation as defined in section 213.010 and this section.
Missouri Revised Statutes § 213.065 establishes that all people in Missouri have an equal right to use places of public accommodation — such as hotels, restaurants, and similar establishments — without being discriminated against or segregated on the basis of race, color, religion, national origin, sex, ancestry, or disability. The law makes it an unlawful discriminatory practice for any person or entity to refuse, deny, or withhold access to the services, facilities, or privileges of such places on those protected grounds. Certain private clubs, religious organizations' facilities, and establishments genuinely not open to the public are exempt, unless those facilities are made available to customers of a covered public accommodation.
Plain English — not legal advice.
Property owners and managers who operate places of public accommodation — including rental office lobbies, leasing facilities, and common areas open to the public — are generally expected under § 213.065 to provide equal access to all persons regardless of race, color, religion, national origin, sex, ancestry, or disability. Compliant operators typically maintain non-discriminatory policies for all services, advantages, and facilities they make available to the public. Operators of genuinely private clubs or religious-organization facilities should be aware that the exemption under § 213.065(3) is narrow and does not apply if those facilities are extended to customers of a covered public accommodation.

Under Mo. Rev. Stat. § 213.065, tenants and prospective tenants have a right to equal access to any place of public accommodation — including rental offices and publicly accessible facilities — free from discrimination based on race, color, religion, national origin, sex, ancestry, or disability. If someone believes they have experienced a violation of § 213.065, general enforcement paths include filing a complaint with the Missouri Commission on Human Rights, which administers the state's anti-discrimination laws. Tenant-rights organizations and legal aid services can also help individuals understand what options may be available under this provision.
