Cal. Civ. Code § 441.160
Executor or administrator of tenant for life may recover rents
Operative Text
The executors or administrators of any tenant for life, who shall have demised any lands or tenements so held, and shall die on or before the day when any rent on such demise shall become payable, may recover: (1) If such tenant for life die on the day, the whole rent; (2) If he die before the day, such proportion of the rent as shall have accrued before his death.
Missouri Revised Statutes § 441.160 addresses what happens to rent owed to a life tenant—someone who holds property only for the duration of their life—when that person dies before or on the date rent is due. Under this provision, the deceased life tenant's estate, through its executor or administrator, retains the right to collect rent that had accrued up to the time of death. If the life tenant died on the exact day rent was due, the full rent amount may be recovered; if death occurred before that day, only the proportionate share that had accrued by the date of death may be collected.
Plain English — not legal advice.
Property owners or managers who lease land or buildings from a life tenant should be aware that under Mo. Rev. Stat. § 441.160, the death of a life tenant does not automatically extinguish rent obligations that accrued during that tenant's lifetime. A compliant operator generally keeps clear records of rent accrual periods and payment schedules, since the life tenant's executor or administrator may present a lawful claim for any rent that had accrued before or on the date of death. Maintaining documentation of lease terms and payment histories helps operators respond accurately to such estate-related claims.

Mo. Rev. Stat. § 441.160 establishes that when a life tenant who leased property to others dies, the right to collect accrued rent passes to that life tenant's estate rather than disappearing. Tenants who receive a rent demand from an executor or administrator following a life tenant's death should understand that this type of claim is recognized under Missouri law, and the amount owed may be prorated based on how much of the rental period had elapsed before the life tenant's death. Those with questions about how this provision applies to their lease arrangement may wish to consult a tenant-rights organization or legal aid service familiar with Missouri property law.
