Cal. Civ. Code § 535.110
Appeals, defendant to furnish bond to stay execution — additional conditions
Operative Text
Applications for trials de novo and appeals shall be allowed and conducted in the manner provided in chapter 512; but no application for a trial de novo or an appeal shall stay execution unless the defendant give bond, with security sufficient to secure the payment of all damages, costs and rent then due, into court within ten days after an entry of the judgment by the trial court, all other provisions of law to the contrary notwithstanding. Additional conditions of the appeal bond shall be to stay waste and to pay all subsequently accruing rent, if any, into court within ten days after it becomes due, pending determination of the trial de novo or appeal. Execution for the purposes of restoring possession shall be stayed pending an appeal if the losing party posts a sufficient appeal bond.
Missouri Revised Statutes § 535.110 governs how defendants in eviction-related cases may appeal or seek a trial de novo while pausing (staying) the enforcement of a judgment against them. To halt execution of the judgment, the defendant must post a bond within ten days of the trial court's ruling that covers damages, costs, and any rent already owed. The bond must also include conditions preventing waste of the property and requiring that any rent accruing during the appeal be paid into court within ten days of each due date. If a sufficient appeal bond is posted, enforcement of an order restoring possession to the landlord is paused while the appeal proceeds.
Plain English — not legal advice.
Under Mo. Rev. Stat. § 535.110, a landlord who has obtained a favorable judgment in an eviction proceeding should be aware that the defendant can delay execution only by posting a qualifying bond within ten days of the judgment. Compliant operators typically monitor whether the required bond has actually been filed and whether ongoing rent obligations are being paid into court as they come due during any appeal period. If the bond is not timely posted or the conditions are not met, the stay of execution does not apply and the landlord may proceed with enforcement.

Mo. Rev. Stat. § 535.110 provides tenants who wish to appeal an eviction judgment a mechanism to pause enforcement of that judgment by posting a bond within ten days of the trial court's ruling. The bond must cover rent already owed, damages, and costs, and must include a commitment to pay future rent into court as it comes due and to avoid waste of the property.
