Cal. Civ. Code § 99.090
Rentals, how fixed
Operative Text
1. It is hereby declared to be the policy of this state that each housing authority shall manage and operate housing projects owned by it in an efficient manner so as to enable it to fix the rentals for its very low and low-income tenants at the lowest possible rates consistent with providing decent, safe and sanitary dwelling accommodations, and at rates not higher than rental guidelines established by the United States Department of Housing and Urban Development for such persons. To this end an authority shall fix the rentals for dwellings in its projects at no higher rates than it shall find to be necessary in order: (1) To pay, as the same become due, the principal and interest on the bonds of the authority; (2) To meet the cost of, and to provide for, maintaining and operating its projects, including the cost of any insurance and any other administrative expenses of the authority; and (3) To create (during not less than the six years immediately succeeding its issuance of any bonds) a reserve sufficient to meet the largest principal and interest payments which will be due on such bonds in any one year and to maintain such reserve. 2. The provisions of this section shall not apply to any moderate income tenants of the authority.
Missouri Revised Statutes § 99.090 establishes a state policy requiring local housing authorities to operate their housing projects efficiently and to set rents for very low and low-income tenants at the lowest rates that still allow the authority to function soundly. Rents may not exceed HUD rental guidelines for those income categories. The rent levels must be sufficient to cover bond debt service, operating and maintenance costs, and a required reserve fund built up over at least six years following any bond issuance. Notably, these rent-ceiling requirements do not extend to moderate-income tenants of the same authority.
Plain English — not legal advice.
Housing authorities operating under Mo. Rev. Stat. § 99.090 are expected to conduct regular efficiency reviews of their projects and set rents for very low and low-income tenants at levels no higher than HUD guidelines permit. Compliant authorities document that their rental schedules cover the three statutory cost categories—bond obligations, operating expenses, and the mandated reserve—without exceeding the lowest rates necessary to do so. Because § 99.090 explicitly exempts moderate-income tenants from these rent ceilings, authorities typically maintain separate rent-setting procedures for that tenant category.

Under Mo. Rev. Stat. § 99.090, very low and low-income tenants living in a state housing authority project have a statutory right to rents set at the lowest rates the authority needs to remain financially viable, and those rents must not exceed HUD rental guidelines for their income category. If a tenant believes their housing authority is charging rents above what § 99.090 allows, they may consider filing a complaint with the U.S. Department of Housing and Urban Development or raising the issue with the housing authority's governing board. Tenant-rights organizations familiar with Missouri public housing law can help explain what documentation or procedural steps are generally available in these situations.
