Neb. Rev. Stat. § 76-1401 et seq. § 76-1418
Landlord to supply possession of dwelling unit.
Operative Text
At the commencement of the term the landlord shall deliver possession of the premises to the tenant in compliance with the rental agreement and section 76-1419 . The landlord may bring an action for possession against any person wrongfully in possession and may recover the damages provided in subsection (3) of section 76-1437 . If the landlord makes reasonable efforts to obtain possession of the premises, he shall not be liable for an action under this section. A tenant who accepts possession and lives on the property for several months thereafter does not have a claim under this section, because the duties described in this section pertain to the "commencement" of the lease term. Vasquez v. CHI Properties, 302 Neb. 742, 925 N.W.2d 304 (2019).
Nebraska Revised Statute § 76-1418 requires that at the start of a tenancy, the landlord must hand over the rental unit in a condition that meets the rental agreement and the habitability standards set out in § 76-1419. If someone else is unlawfully occupying the unit at that time, the landlord has the right to pursue legal action to recover possession and may seek damages under § 76-1437(3). Importantly, a landlord who makes reasonable efforts to obtain possession is shielded from liability, and a tenant who accepts possession and lives in the unit for several months generally cannot later bring a claim under this section, as the Nebraska Supreme Court clarified in Vasquez v. CHI Properties (2019).
Plain English — not legal advice.
Under § 76-1418, compliant property operators ensure the rental unit is ready and legally deliverable to the incoming tenant on the first day of the lease term, consistent with the rental agreement and § 76-1419 habitability requirements. If a prior occupant or holdover tenant is preventing timely delivery, operators generally document their efforts to recover possession promptly, since demonstrating reasonable efforts provides a statutory defense against liability. Keeping records of move-in dates, condition reports, and any steps taken to clear the unit can support a showing of compliance with this provision.

Section § 76-1418 gives tenants the right to receive their rental unit at the start of the lease term in a condition that matches the rental agreement and meets Nebraska's habitability standards under § 76-1419. If a landlord fails to deliver possession at the commencement of the tenancy, a tenant may have grounds to raise a claim under this provision, though the Nebraska Supreme Court held in Vasquez v. CHI Properties (2019) that accepting possession and living in the unit for an extended period generally forecloses such a claim. Tenants who believe their rights under § 76-1418 were violated at move-in may consider consulting a tenant-rights organization or legal aid service to understand available options.
