Neb. Rev. Stat. § 76-1450 et seq. § 76-1498
Noncompliance by landlord; tenant's rights.
Operative Text
(1) If there is a material noncompliance by the landlord with the rental agreement or a noncompliance with section 76-1492 materially affecting health and safety, the tenant may deliver a written notice to the landlord specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than thirty days after receipt of the notice if the breach is not remedied or if reasonable steps to remedy the breach have not been taken in fourteen days. The rental agreement shall terminate and the mobile home space shall be vacated as provided in the notice subject to the following: (a) If the breach is remediable by repairs or the payment of damages or otherwise and the landlord adequately remedies the breach or takes reasonable steps to remedy it prior to the date specified in the notice, the rental agreement will not terminate; and (b) The tenant may not terminate for a condition caused by the deliberate or negligent act or omission of the tenant, a member of the tenant's family, or other person in the mobile home park with the tenant's consent. (2) A tenant may recover damages and obtain injunctive relief for any material noncompliance by the landlord with the rental agreement or section 76-1492 . (3) The remedy provided in subsection (2) of this section shall be in addition to any right of the tenant arising under subsection (1) of this section. (4) If the rental agreement is terminated, the landlord shall return any prepaid rent and any rental deposit, less any allowable deductions, recoverable by the tenant under section 76-1485 .
Nebraska Revised Statute § 76-1498 establishes what happens when a landlord materially fails to comply with a mobile home rental agreement or with the health-and-safety maintenance standards set out in § 76-1492. A tenant who experiences such a failure may serve written notice giving the landlord at least 14 days to fix the problem and specifying that the agreement will end no sooner than 30 days after the landlord receives the notice if the problem goes unresolved. Beyond termination, the statute also allows a tenant to seek monetary damages and injunctive relief, and requires the landlord to return prepaid rent and any rental deposit (minus allowable deductions) if the agreement is ultimately terminated.
Plain English — not legal advice.
Under § 76-1498, mobile home park operators who receive a written notice of material noncompliance have a critical 14-day window in which to remedy the identified breach or take reasonable steps toward remedying it, which can prevent the rental agreement from terminating. Compliant operators generally document all repair efforts and communications during that window to demonstrate that reasonable steps were taken. Landlords should also be aware that if a tenancy does terminate under this provision, they are obligated to return prepaid rent and the rental deposit, subject only to deductions permitted under § 76-1485.

Section 76-1498 gives mobile home tenants in Nebraska meaningful options when a landlord materially fails to uphold the rental agreement or the health-and-safety standards referenced in § 76-1492. Tenants generally have the right to deliver written notice specifying the breach, pursue termination of the rental agreement if the landlord does not remedy the problem within the stated timeframes, and separately seek damages or injunctive relief through the courts. Tenants who believe their rights under this provision have been violated may consider consulting a tenant-rights organization or legal aid office to understand the full range of remedies available to them.
