N.H. Rev. Stat. Ann. § 205-A: § 205-A:13-c
General Applicability.
Operative Text
I. A manufactured housing park owner shall assure that the roads are passable and common areas within the manufactured housing park are safe and fit for the purpose for which they were reasonably intended. II. Cooperative housing parks shall be subject to the provisions of RSA 205-A. III. In the rental of any lot in a manufactured housing park there shall be an implied warranty of habitability whereby the park owner warrants, at the inception and throughout the tenancy, that, if provided by the owner: (a) There is a functioning water supply system which, if the source is provided by the owner, shall provide safe drinking water in accordance with the applicable standards established by the department of environmental services in quantities to meet ordinary household needs of the tenant. (b) There is a safely functioning sewage disposal system, which shall be in accordance with the applicable standards established by the department of environmental services, available to the tenant household. IV. The housing standards set forth under RSA 48-A shall also apply to manufactured housing parks.
Under N.H. Rev. Stat. Ann. § 205-A:13-c, manufactured housing park owners are subject to a set of baseline obligations covering the physical condition of their parks. Roads and common areas must be kept passable and safe for their intended use. When an owner provides water or sewage systems, those systems must meet state environmental standards and remain functional throughout a tenancy — not just at move-in. Cooperative housing parks and the broader housing standards of RSA 48-A are also brought within this framework.
Plain English — not legal advice.
Operators of manufactured housing parks should understand that § 205-A:13-c creates an ongoing, implied warranty of habitability that runs for the entire duration of each tenancy — not merely at the time a lease begins. Compliant park owners routinely inspect and maintain roads and common areas to keep them passable and safe, and they ensure that any water supply or sewage disposal system they provide meets the standards set by the New Hampshire Department of Environmental Services. Owners of cooperative housing parks should also confirm that their operations align with the full scope of RSA 205-A, and all park owners should be familiar with the housing standards incorporated by reference from RSA 48-A.

Tenants renting lots in manufactured housing parks in New Hampshire have protections under § 205-A:13-c, including an implied warranty of habitability that covers safe drinking water and functioning sewage disposal when those systems are owner-provided. If roads, common areas, or utility systems fall below the standards described in this provision, tenants may have grounds to raise a habitability violation — options can include notifying the park owner in writing, contacting the New Hampshire Department of Environmental Services regarding water or sewage concerns, or consulting a tenant-rights organization familiar with RSA 205-A. Understanding how RSA 48-A housing standards interact with this provision can also be relevant when evaluating the condition of a park.
