N.H. Rev. Stat. Ann. § 205-A: § 205-A:18
Powers of Receivers.
Operative Text
If the court appoints a receiver pursuant to RSA 205-A:17, III, the receiver shall have such powers and duties as the court shall determine including the right to: I. Collect rents from every manufactured housing resident who is renting a lot in the park. II. Disburse the rent collected for mortgage payments, taxes, and operating expenses as they come due, and for the payment of other expenses necessary for the operation and maintenance of the park. III. Make contracts and payments necessary to abate and correct the dangerous conditions. IV. Evict tenants pursuant to the provisions of this chapter. V. Collect reasonable fees for services as authorized by the court.
Under N.H. Rev. Stat. Ann. § 205-A:18, when a court appoints a receiver to oversee a manufactured housing park, that receiver is granted broad authority to keep the park functioning. This authority includes collecting lot rents from residents, paying the park's ongoing financial obligations such as mortgages and taxes, entering into contracts to fix dangerous conditions, and even initiating eviction proceedings under the same chapter. The receiver acts under court supervision and may collect reasonable fees for these services as the court permits.
Plain English — not legal advice.
Park owners and operators subject to a receivership under § 205-A:18 should understand that once a court-appointed receiver takes over, the receiver assumes control of rent collection and financial disbursements that would otherwise be the owner's responsibility. Compliant operators generally maintain accurate records of mortgage obligations, tax schedules, and operating expenses so that any court-supervised transition can proceed with minimal disruption. Owners facing potential receivership proceedings under RSA 205-A:17, III are generally well-served by keeping park infrastructure in safe, code-compliant condition to avoid the circumstances that trigger such appointments.

Residents of manufactured housing parks should know that § 205-A:18 gives a court-appointed receiver the legal authority to collect their lot rent directly, even if the park's owner is no longer managing the property. Tenants retain their rights under this chapter, including protections related to any eviction proceedings the receiver might initiate. Residents who have questions about how a receivership affects their tenancy or rent obligations may find it helpful to contact a tenant-rights organization or consult with a housing attorney familiar with New Hampshire manufactured housing law.
