N.H. Rev. Stat. Ann. § 540-B: § 540-B:7
Remedies.
Operative Text
I. Violations of this chapter shall be subject to the remedies set forth in RSA 540-A:4, however, a tenant of a shared facility must identify in the petition, which may be by a checkbox on the circuit court's form petition, that their rental is governed by RSA 540-B. II. A tenant shall not enjoy the remedies set forth in RSA 540-A:4 in regard to tenant lockout if the owner or agent of the owner of the shared facility has complied with the requirements of RSA 540-B:3.
Under N.H. Rev. Stat. Ann. § 540-B:7, violations of the shared-facility rental chapter are addressed through the same remedy framework established in RSA 540-A:4, which covers protections against landlord interference with a tenant's rights. However, tenants living in shared facilities must specifically indicate on their court petition that their rental falls under RSA 540-B. Notably, the lockout-related remedies available under RSA 540-A:4 do not apply when the owner or their agent has properly followed the notice and access requirements outlined in RSA 540-B:3.
Plain English — not legal advice.
Operators of shared facilities governed by RSA 540-B should be aware that § 540-B:7 ties enforcement of this chapter to the remedy provisions of RSA 540-A:4, which can include court-ordered relief and related consequences. Landlords who fully comply with the procedural requirements of RSA 540-B:3—such as proper notice before entering shared spaces—are shielded from the lockout-specific remedies that would otherwise be available to tenants. Maintaining clear documentation of compliance with RSA 540-B:3 is a practice commonly associated with operators who successfully demonstrate adherence to the statute.

Tenants renting in a shared facility have access to the remedies provided under RSA 540-A:4 when a landlord violates RSA 540-B, but § 540-B:7 requires that any petition filed with the circuit court specifically identify the rental as being governed by RSA 540-B, which can be done via a checkbox on the court's standard form. However, the lockout-related remedies under RSA 540-A:4 are not available if the owner has complied with RSA 540-B:3's requirements. Tenants who believe their rights have been violated may consider consulting a tenant-rights organization or legal aid service to understand which remedies may apply to their circumstances.
