Plain English

New Hampshire Revised Statutes § 540-C:1 defines the specific category of dwelling units covered by Chapter 540-C. A unit falls under this chapter if it is rented for recreational or vacation purposes for at least one month per year and is also rented as a primary residence—by tenants who have no other home—during the remaining non-recreational or non-vacation period. This dual-use requirement is what distinguishes these units from ordinary year-round rentals or purely seasonal properties.

For Property Managers

Property owners who rent a unit seasonally for recreation or vacation but also rent it to full-time residents during the off-season should be aware that § 540-C:1 may bring that unit within the scope of Chapter 540-C. Compliant operators typically assess whether both conditions—seasonal recreational use and off-season residential use by tenants with no other residence—are met before determining which regulatory framework governs their lease agreements. Understanding this classification helps operators apply the correct rules for notices, evictions, and tenant protections.

For Tenants

Under § 540-C:1, tenants who rent a unit as their sole residence during the non-recreational or non-vacation portion of the year may have protections under New Hampshire's Chapter 540-C, even if the same unit is rented for vacation or recreational purposes at other times of year. Tenants in this situation can review whether both conditions in the statute apply to their dwelling to understand whether this chapter's provisions extend to them. Tenant-rights organizations in New Hampshire can help clarify whether a specific living arrangement qualifies under this provision.
