N.J. Stat. Ann. § 2A:18-51 et seq. § 2A:18-61.29
Registration of conversion; approval after proof of notice of eligibility to tenants
Operative Text
No registration of conversion shall be approved until the Department of Community Affairs receives proof that the administrative agency or officer has made determinations and notified all tenants who applied for protected tenancy status within the initial 60-day period of their eligibility or lack of eligibility. The proof shall be by affidavit or in such other form as the department may require. The department may grant registrations of conversion for applications pending on the effective date of this amendatory and supplementary act upon the implementation of a procedure whereby any eligible tenant may make application for protected tenancy status in a manner comparable to that specified in sections 6 and 7 of this amendatory and supplementary act. L.1981, c. 226, s. 8, eff. July 27, 1981.
Under N.J.S.A. 2A:18-61.29, a residential building conversion cannot be officially registered until the New Jersey Department of Community Affairs has received proof that every tenant who applied for protected tenancy status within the initial 60-day window was individually notified of whether they qualify. That proof must be submitted by affidavit or in another form the Department accepts. For conversion applications that were already pending when this law took effect, the Department may approve registrations if a comparable application procedure for eligible tenants is put in place.
Plain English — not legal advice.
Operators pursuing a residential conversion under N.J.S.A. 2A:18-61.29 generally ensure that the administrative agency or officer completes eligibility determinations for all tenants who applied during the 60-day protected tenancy window before seeking registration approval. Compliant operators then submit the required proof—typically an affidavit—to the New Jersey Department of Community Affairs confirming that each applicant received written notice of their eligibility status. For conversions that were pending at the time this law became effective, operators work with the Department to implement a comparable application procedure that satisfies the statute's requirements.

N.J.S.A. 2A:18-61.29 establishes that tenants who applied for protected tenancy status during the initial 60-day period are entitled to receive a formal determination and written notice of whether they qualify before any conversion registration is approved. If a tenant believes they were not properly notified or that their application was overlooked, they may consider contacting the New Jersey Department of Community Affairs, which holds authority over the registration process. Tenants may also wish to consult a tenant-rights organization or legal aid provider familiar with New Jersey conversion law to understand what options may be available to them.
