N.J. Stat. Ann. § 2A:18-51 et seq. § 2A:18-61.30
Protected tenancy status; applicability after notice of eligibility and filing of conversion recording
Operative Text
Protected tenancy status shall not be applicable to any eligible tenant until such time as the owner has filed his conversion recording. The protected tenancy status shall automatically apply as soon as a tenant receives notice of eligibility and the landlord files his conversion recording. The conversion recording shall not be filed until after the registration of conversion. L.1981, c. 226, s. 9, eff. July 27, 1981.
Under N.J.S.A. 2A:18-61.30, protected tenancy status for eligible tenants in a conversion context does not take effect automatically from the moment of eligibility alone. Instead, two conditions must both be met before the protection activates: the tenant must have received a notice of eligibility, and the landlord must have filed the conversion recording with the appropriate authority. Additionally, the conversion recording itself cannot be filed until after the conversion has been properly registered, establishing a sequential process that governs when protections begin.
Plain English — not legal advice.
Property owners managing a condominium or cooperative conversion under N.J.S.A. 2A:18-61.30 generally ensure that the conversion is fully registered before filing any conversion recording, since filing is not permitted beforehand. Compliant operators also track the point at which eligible tenants receive their notices of eligibility, because that event—combined with the filing of the conversion recording—triggers protected tenancy status automatically. Maintaining clear documentation of registration dates, recording filing dates, and notice delivery dates helps demonstrate adherence to the sequential requirements this provision establishes.

N.J.S.A. 2A:18-61.30 establishes that eligible tenants in a conversion building gain protected tenancy status automatically once they have received a notice of eligibility and the landlord has filed the conversion recording—neither step alone is sufficient. If a landlord attempts to proceed with a conversion or take action against a tenant before both conditions are satisfied, the absence of properly triggered protected status may be relevant to any dispute. Tenants who have questions about whether they have received proper notice or whether a conversion recording was filed in the correct sequence may find it useful to contact a local tenant-rights organization or review records with the municipality where the property is located.
