N.J. Stat. Ann. § 2A:18-51 et seq. § 2A:18-61.57
Removal for good cause
Operative Text
18. Nothing in this act shall be deemed to prevent a court from removing a tenant, qualified tenant or tenant in need of comparable housing from a dwelling unit located in a qualified county for good cause shown not to be related to conversion of the building or structure to a condominium or cooperative. L.1991,c.509,s.18.
N.J.S.A. 2A:18-61.57 clarifies that the protections established by this act do not eliminate a court's existing authority to order the removal of a tenant—including qualified tenants and those entitled to comparable housing—from a dwelling unit in a qualified county. The key condition is that any such removal must be grounded in 'good cause' that is entirely unrelated to a building's conversion to a condominium or cooperative. In other words, the act limits conversion-driven evictions but does not shield tenants from eviction proceedings based on other legitimate legal grounds.

Under N.J.S.A. 2A:18-61.57, property owners in qualified counties retain the ability to pursue court-ordered removal of tenants for valid, non-conversion-related reasons even when the broader act's tenant protections apply. Compliant operators generally document the specific grounds for any removal action and ensure those grounds are wholly independent of any condominium or cooperative conversion activity. Maintaining clear records that distinguish ordinary lease violations or other good-cause grounds from any conversion-related activity is a practice commonly associated with lawful operation under this provision.

N.J.S.A. 2A:18-61.57 preserves important protections for tenants, qualified tenants, and tenants in need of comparable housing in qualified counties by requiring that any court-ordered removal be based on good cause unrelated to a building's conversion to a condominium or cooperative. If a tenant believes a removal action is actually motivated by a conversion rather than a legitimate independent reason, that connection may be relevant to raise as part of a court proceeding. Tenants facing removal in a qualified county may wish to consult a tenant-rights organization or legal aid service to understand how this provision and the broader act may apply to their circumstances.
