N.J. Stat. Ann. § 2A:18-51 et seq. § 2A:18-83
Applicability of act
Operative Text
14. This act shall not be applicable to any unclaimed property which must be disposed of in accordance with the "Uniform Unclaimed Property Act (1981)," P.L.1989, c.58 (R.S.46:30B-1 et seq.). L.1999,c.340,s.14.
Section 2A:18-83 of N.J.S.A. 2A:18-51 et seq. establishes a boundary on the reach of the act by carving out unclaimed property that falls under New Jersey's Uniform Unclaimed Property Act (P.L.1989, c.58). When property qualifies as 'unclaimed' under that separate statutory framework, the disposal rules of this act do not apply to it. Instead, the Uniform Unclaimed Property Act governs how such property must be handled and disposed of.
Plain English — not legal advice.
Property owners and managers operating under N.J.S.A. 2A:18-51 et seq. § 2A:18-83 should be aware that not all abandoned or leftover property falls under this act's disposal procedures. When property meets the legal definition of 'unclaimed property' under P.L.1989, c.58 (R.S.46:30B-1 et seq.), compliant operators follow the separate requirements of the Uniform Unclaimed Property Act rather than the procedures outlined in this act. Keeping clear records of what category any abandoned property falls into helps ensure the correct statutory framework is applied.

Under N.J.S.A. 2A:18-51 et seq. § 2A:18-83, tenants should know that property left behind after a tenancy may be subject to different legal rules depending on its classification. If property qualifies as 'unclaimed' under New Jersey's Uniform Unclaimed Property Act (P.L.1989, c.58), the protections and procedures of this act do not govern its disposal — the Uniform Unclaimed Property Act does instead. Tenants who believe their property has been improperly handled may wish to consult a tenant-rights organization or review both statutory frameworks to understand which set of rules applies to their situation.
