Under N.J.S.A. 46:8C-4, mobile home park owners and operators in New Jersey are required to offer written leases or rental agreements of at least 12 months to residents—both to existing dwellers within 30 days of the law's enactment and to new dwellers within 30 days of their lawful move-in. Before any lease is signed, the park's rules and regulations must be delivered in writing to the prospective resident. Those same rules and regulations must also be posted in a visible, accessible location within the park, such as a recreation hall or another conspicuous common area.
Plain English — not legal advice.
Mobile home park owners and operators subject to N.J.S.A. 46:8C-4 generally ensure that a written lease or rental agreement covering at least a 12-month term is offered to each new resident within 30 days of their move-in. Compliant operators also provide a written copy of all park rules and regulations to a prospective resident before that person signs any lease or rental agreement. Additionally, operators typically maintain a posted copy of those rules and regulations in the park's recreation hall or another prominent common area so that all residents have ongoing access to them.

Under N.J.S.A. 46:8C-4, mobile home park residents have the right to be offered a written lease or rental agreement for a term of at least 12 months, and to receive a written copy of the park's rules and regulations before signing any lease. If a park owner or operator fails to meet these obligations—such as by withholding the rules and regulations prior to lease signing or refusing to offer a written lease—tenants may have grounds to raise these failures as a concern with New Jersey housing authorities or a tenant-rights organization familiar with mobile home park law. Consulting a tenant advocacy group or legal aid service can help residents understand what remedies or complaint processes may be available under this provision.
