N.J. Stat. Ann. § 55:13A-1 et seq. § 55:13A-31
Rules, regulations
Operative Text
3. The Commissioner of Health, in consultation with the Department of Community Affairs, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.) shall adopt rules and regulations necessary to effectuate the purposes of this act. L.2020, c.37, s.3.
Under N.J.S.A. 55:13A-1 et seq. § 55:13A-31, the New Jersey Commissioner of Health is authorized and directed to create the administrative rules and regulations needed to carry out the broader hotel and multiple dwelling law, doing so in consultation with the Department of Community Affairs and following the procedures set out in the state's Administrative Procedure Act. This provision is essentially an enabling clause — it does not itself impose specific duties on landlords or tenants, but it gives the regulatory framework its legal foundation. The rules adopted under this authority have the force of law once finalized through the required administrative process.
Plain English — not legal advice.
Property owners and managers subject to New Jersey's hotel and multiple dwelling statutes should be aware that § 55:13A-31 is the provision that empowers the Commissioner of Health to issue binding regulations implementing those statutes. Compliant operators generally monitor the New Jersey Register for rules promulgated under this authority, since those regulations set the specific standards — covering habitability, inspections, and related matters — that govern day-to-day operations. Staying current with any regulatory updates issued under N.J.S.A. 55:13A-1 et seq. § 55:13A-31 is a common practice among operators seeking to maintain compliance.

N.J.S.A. 55:13A-1 et seq. § 55:13A-31 is the legal basis for the detailed health and housing regulations that the Commissioner of Health issues to protect occupants of hotels and multiple dwellings in New Jersey. When tenants believe a condition in their building violates those regulations, general enforcement paths include filing a complaint with the local housing or health authority or contacting a tenant-rights organization familiar with rules adopted under this provision. Understanding that § 55:13A-31 is the source of the Commissioner's rulemaking power can help tenants identify which agency's regulations apply to their situation.
