N.M. Stat. Ann. § 47-10-15.1
New or amended rules; notification; open meeting; pets; physical improvements.
Operative Text
47-10-15.1. New or amended rules; notification; open meeting; pets; physical improvements.
A. The management shall notify mobile home park residents of proposed new rules
or amendments to existing rules at least sixty days prior to the effective date of the new
or amended rules. The management shall allow residents a thirty-day comment period
on proposed rule changes. Comments from residents to management on proposed rule
changes shall be in writing and signed by the author. Once all comments have been
received, the management shall post all comments and the responses to the comments
in a conspicuous place. The new rules or amended rules shall not take effect before
sixty days after the notification date.
B. Existing pets that are in compliance with the mobile home park rules or
regulations shall be exempt from any provision of new rules or regulations that would
prohibit those pets provided those are not a nuisance violating the public peace, health
or safety.
C. The mobile home park management shall not require existing residents to
comply with changes in rules or regulations that require physical improvements to the
existing resident's mobile home or lot unless the mobile home is in violation of a local
municipal or county ordinance or the physical condition of the resident's mobile home or
lot constitutes a public nuisance or threat to the public peace, health or safety.
History: Laws 1997, ch. 186, § 5.Under NMSA § 47-10-15.1, mobile home park management must give residents at least sixty days' advance notice before any new or amended rules take effect, and must allow a thirty-day written comment period during which all comments and management's responses must be posted publicly. Pets that already comply with existing park rules are shielded from new rules that would ban them, as long as they are not a nuisance to public peace, health, or safety. Additionally, existing residents cannot be required to make physical improvements to their mobile home or lot under new rules unless the home violates a local ordinance or poses a genuine public nuisance or safety threat.
Plain English — not legal advice.
Operators of mobile home parks in New Mexico must follow the procedural steps set out in NMSA § 47-10-15.1 when introducing or changing park rules: issuing written notice at least sixty days before the effective date, opening a thirty-day comment window, and conspicuously posting all written resident comments alongside management's responses. When drafting new pet-related rules, compliant operators recognize that residents with pets already meeting current rules retain those pets under the grandfathering protection, absent a documented nuisance concern. Similarly, rule changes that would mandate physical upgrades to existing homes or lots generally cannot be enforced against current residents unless a local ordinance violation or public safety issue is documented.

NMSA § 47-10-15.1 gives mobile home park residents the right to receive at least sixty days' notice of proposed rule changes and to submit written, signed comments during a thirty-day comment period, with all comments and responses posted in a visible location. If you have a pet that currently complies with park rules, that pet is generally protected from being prohibited by any newly enacted rule, provided it is not causing a nuisance. Residents who believe management is attempting to enforce new physical-improvement requirements without a valid ordinance or safety basis may consider raising this provision as a defense, contacting the New Mexico Attorney General's consumer protection office, or reaching out to a local tenant-rights or mobile-home-owner advocacy organization for general information.
