N.M. Stat. Ann. § 47-10-18
Conflicts; applicability of law.
Operative Text
47-10-18. Conflicts; applicability of law.
Unless a provision of the Mobile Home Park Act directly conflicts with the provisions
of the Uniform Owner-Resident Relations Act [47-8-1 to 47-8-52 NMSA 1978], the
provisions of the Uniform Owner-Resident Relations Act shall apply to mobile home
park owners and residents.
History: Laws 1989, ch. 253, § 4.Section 47-10-18 of the Mobile Home Park Act establishes a relationship between two New Mexico statutes: the Mobile Home Park Act and the Uniform Owner-Resident Relations Act (NMSA 47-8-1 to 47-8-52). Where the two laws do not directly conflict, the broader protections and requirements of the Uniform Owner-Resident Relations Act extend to mobile home park settings. This means the rights and obligations found in the Uniform Owner-Resident Relations Act generally govern the relationship between mobile home park owners and residents unless the Mobile Home Park Act specifically says otherwise.
Plain English — not legal advice.
Under § 47-10-18, mobile home park operators in New Mexico are generally subject to the full scope of the Uniform Owner-Resident Relations Act (NMSA 47-8-1 to 47-8-52) in addition to the Mobile Home Park Act itself. Compliant operators typically familiarize themselves with both statutes, applying the Uniform Owner-Resident Relations Act wherever the Mobile Home Park Act does not provide a directly conflicting rule. Reviewing both bodies of law together helps ensure that lease terms, notice procedures, and maintenance obligations meet the combined requirements.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Residents of New Mexico mobile home parks benefit from § 47-10-18 because it extends the protections of the Uniform Owner-Resident Relations Act (NMSA 47-8-1 to 47-8-52) to their living situation, not just the narrower Mobile Home Park Act. This means tenants may be able to invoke rights found in the Uniform Owner-Resident Relations Act — such as habitability standards or notice requirements — when those provisions do not conflict with the Mobile Home Park Act. Tenants who believe their rights under either statute have been violated may consider consulting a tenant-rights organization or reviewing the New Mexico courts' self-help resources to understand available enforcement paths.
