Plain English

Under NMSA 47-10-22, when a mobile home park landlord purchases utility services on behalf of residents and passes those costs along, the landlord must provide each resident with a monthly itemized bill. That bill must separately list each utility service, show the amount consumed and the cost per unit, and—when individual unit costs are unavailable—disclose the total utility cost and the formula used to calculate each resident's share. If the landlord charges an administrative fee for managing utility services, that fee must also appear as a distinct line item on the bill.

For Property Managers

Operators of mobile home parks who purchase and resell or pass through utility costs to residents are required under NMSA 47-10-22 to issue a monthly itemized statement for those charges. A compliant operator maintains records of consumption data and per-unit costs for each utility, prepares separate line items for each service, and clearly discloses any administrative fee charged for providing those services. When individual per-unit cost figures are not available from the utility provider, compliant operators document and share the total utility cost alongside the allocation formula used to derive each resident's portion.

For Tenants

NMSA 47-10-22 gives mobile home park residents the right to receive a detailed monthly bill whenever their landlord purchases utility services and charges them for those costs. Residents are entitled to see each utility listed separately, the consumption amounts and per-unit rates (or the total cost and allocation formula if per-unit rates are unavailable), and any administrative fee the landlord is collecting. Residents who believe their bills do not meet these requirements may raise the issue with a local tenant-rights organization, contact the New Mexico Attorney General's consumer protection division, or consult a housing attorney to understand available remedies.
