N.M. Stat. Ann. § 47-10-8
Security deposits.
Operative Text
47-10-8. Security deposits. The owner of a mobile home park or his agents may charge a security deposit not greater than the amount of one month's rent or two months' rent for multiwide units. History: Laws 1983, ch. 122, § 8.
Under NMSA 47-10-8, mobile home park owners are permitted to collect a security deposit from residents, but the amount is capped by law. For a standard (single-wide) unit, the deposit cannot exceed one month's rent; for multiwide units, the cap rises to two months' rent. This rule sets an upper boundary on what can be collected upfront, protecting residents from excessive deposit demands while still allowing owners to secure some financial protection.
Plain English — not legal advice.
Under NMSA 47-10-8, compliant mobile home park operators collect security deposits that stay at or below the statutory caps — one month's rent for standard units and two months' rent for multiwide units. Operators generally document the deposit amount in the lease agreement and keep clear records of how the deposit is held and ultimately returned or applied. Charging above these limits would place the owner outside the bounds set by the Mobile Home Park Act.

NMSA 47-10-8 limits how much a mobile home park owner can require as a security deposit — no more than one month's rent for a standard unit, or two months' rent if you occupy a multiwide unit. If a deposit demand exceeds these caps, that may constitute a violation of the Mobile Home Park Act, which tenants can raise as a concern. General enforcement paths include contacting the New Mexico Attorney General's consumer protection division, reaching out to a local tenant-rights organization, or consulting a housing attorney familiar with New Mexico mobile home park law.
