(1995, c. 419, s. 1.)
N.C. Gen. Stat. § 42-70 governs how and when discovery may be conducted in residential rental disputes brought or appealed under this Article in district court. Defendants must kick off any discovery they want within the same window allowed for filing an answer or counterclaim, while plaintiffs have 20 days from receiving a defendant's answer or counterclaim to begin their own discovery. Responses to interrogatories, document requests, and requests for admissions are due within 20 days of service. Courts may also issue a preliminary injunction against alleged illegal activity by a defendant or other residents or guests of the rental unit while discovery is still ongoing.

Under N.C. Gen. Stat. § 42-70, landlords who bring an action under this Article in district court—or whose case is appealed there—must initiate any discovery within 20 days of receiving a defendant's answer or counterclaim. Compliant operators track these deadlines carefully and respond to any discovery requests served on them within the 20-day response window. Landlords should also be aware that § 42-70(e) allows the court to issue a preliminary injunction against alleged illegal activity by tenants, other residents, or guests during the discovery period, either upon the landlord's application or by agreement of the parties.

N.C. Gen. Stat. § 42-70 sets firm discovery timelines that apply to both sides in district court rental actions under this Article, meaning tenants have the right to initiate discovery—such as interrogatories or document requests—within the window allowed for filing an answer or counterclaim. Tenants who receive discovery requests must respond within 20 days under § 42-70(d). Tenants facing a preliminary injunction under § 42-70(e) may wish to consult a tenant-rights organization or legal aid office to understand how that order could affect them during the pendency of the case.
