13 N.C.A.C. § 13 NCAC 16 .0202
MIGRANT HOUSING CERTIFICATE
Operative Text
(a) If no violations are identified during the preoccupancy inspection, the Department shall issue a migrant housing certificate to the operator. (b) Upon notification of any violations, the operator shall correct the violation(s) and so certify on the form supplied by the Department. The operator shall provide any access or information requested by the Department to verify that the identified violations have been abated. When the violative conditions are corrected, the Department shall issue a migrant housing certificate to the operator. (c) Except as provided in G.S. 95-226(d) and (e), no migrant housing shall be occupied prior to the receipt and posting, in a place accessible to all migrants, of a migrant housing certificate.
Under 13 N.C.A.C. 16 .0202, migrant housing in North Carolina must receive a certificate from the Department before it can be occupied, unless a narrow statutory exception applies. If a preoccupancy inspection finds no violations, the certificate is issued directly; if violations are found, the operator must correct them and allow the Department to verify the corrections before a certificate is granted. The certificate must then be posted in a location accessible to all migrants living at the site.
Plain English — not legal advice.
Operators of migrant housing should be familiar with 13 N.C.A.C. 16 .0202, which establishes that a valid migrant housing certificate must be obtained and conspicuously posted before any migrant occupies the facility. Compliant operators schedule preoccupancy inspections, promptly address any identified violations, and cooperate fully with Department requests for access or documentation to confirm that corrections have been made. Allowing occupancy before the certificate is received and posted—outside the limited exceptions in G.S. 95-226(d) and (e)—puts the operator out of compliance with this rule.

Migrant workers have a right under 13 N.C.A.C. 16 .0202 to live in housing that has passed a preoccupancy inspection and holds a current migrant housing certificate, which must be posted where all residents can see it. If a certificate is not visibly posted or if housing appears to have been occupied before one was issued, that may indicate a violation of this rule. Tenants who believe this provision has not been followed may contact the North Carolina Department of Labor, reach out to a local tenant-rights or farmworker advocacy organization, or raise the issue as part of any relevant administrative or legal proceeding.
