Section 33-33-01-02 of the North Dakota Administrative Code requires that anyone seeking to build a new mobile home park, or to alter or expand an existing one, must first submit a complete set of scaled plans and detailed specifications to the state department for review and approval. The submission must include a comprehensive package of information covering the property's legal description, developer and designer identities, lot layouts, road and parking details, utility systems, and approved soil testing results. Any portion of an existing park that is enlarged must comply with all rules and regulations that are in effect at the time the enlargement takes place.

For Property Managers

Operators and developers subject to N.D. Admin. Code § 33-33-01-02 generally prepare a thorough application package before breaking ground on a new mobile home park or expanding an existing one, ensuring the scaled plans and specifications address every element listed in the provision — from legal property descriptions and lot dimensions to water, sewer, and electrical system details. Compliant operators also obtain and include approved soil testing results as part of the submission, since incomplete applications are not eligible for departmental approval. When enlarging an existing park, operators ensure that the expanded portion meets all current regulations in force at the time of the project.

For Tenants

Residents of mobile home parks in North Dakota benefit from N.D. Admin. Code § 33-33-01-02 because it requires that any new park or expansion of an existing park receive state departmental approval before development proceeds, helping to ensure that basic infrastructure — including water supply, sewer, refuse disposal, lighting, and road access — meets established standards. If a tenant believes a park expansion was carried out without the required approvals or does not meet the specifications mandated by this section, they may consider contacting the relevant North Dakota state department to inquire about the park's compliance status. Tenant-rights organizations familiar with North Dakota housing regulations can also help residents understand what remedies or complaint processes may be available.
