Operative Text
14-02.5-22. Conciliation.
The department shall, during the period beginning with the filing of a complaint and ending
with the filing of a charge or a dismissal by the department, to the extent feasible, engage in
conciliation with respect to the complaint. A conciliation agreement between a respondent and
the complainant is subject to departmental approval. A conciliation agreement may provide for
binding arbitration or another method of dispute resolution. Dispute resolution that results from a
conciliation agreement may authorize appropriate relief, including monetary relief.Section 14-02.5-22 of the North Dakota Century Code establishes a conciliation process that the Department of Labor and Human Rights must pursue after a fair housing complaint is filed and before any formal charge or dismissal is issued. During this window, the department works with both the person who filed the complaint and the person or entity accused of a violation to reach a mutually acceptable resolution. Any agreement reached through conciliation must be approved by the department and can include binding arbitration, other dispute-resolution methods, and monetary relief for affected parties.

Under N.D.C.C. § 14-02.5-22, once a fair housing complaint is filed against a property owner or manager, the department is required to attempt conciliation before the matter proceeds to a formal charge. Operators who engage constructively in this process may reach a department-approved agreement that resolves the complaint through negotiated terms, which can include financial remedies or alternative dispute-resolution mechanisms. Maintaining thorough records of fair housing policies and communications is a practice that generally supports a respondent's position during the conciliation phase.

N.D.C.C. § 14-02.5-22 gives complainants the right to participate in a department-facilitated conciliation process after a fair housing complaint is filed. Through this process, a complainant may reach a binding agreement with the respondent that can include monetary relief or other remedies, all subject to departmental approval. Tenants who have filed a complaint may wish to consult a tenant-rights organization or legal aid provider to better understand what types of relief a conciliation agreement under this provision can authorize.
