Investigative report.
Operative Text
14-02.5-24. Investigative report.
The department shall prepare a final investigative report, including the names of and dates
of contacts with witnesses, a summary of correspondence and other contacts with the aggrieved
person and the respondent showing the dates of the correspondence and contacts, a summary
description of other pertinent records, a summary of witness statements, and answers to
interrogatories. A final report under this section may be amended if additional evidence is
discovered.Section 14-02.5-24 of the North Dakota Century Code requires the state department handling housing discrimination complaints to compile a formal investigative report once its inquiry is complete. This report must document witness contacts and dates, summarize correspondence with both the complainant and the respondent, describe relevant records, and capture witness statements and interrogatory answers. The report is not necessarily final in an absolute sense — it can be amended if new evidence comes to light after it is initially prepared.

Under N.D.C.C. § 14-02.5-24, when a housing discrimination complaint is filed against a property owner or manager, the department will build a structured investigative record that includes all contacts, correspondence, and statements gathered during the inquiry. Compliant operators generally maintain organized records of their own communications and interactions related to any complaint, since those exchanges may be summarized in the official report. Because the report can be amended upon discovery of additional evidence, the investigation may continue to develop even after an initial report is issued.

Section 14-02.5-24 gives complainants assurance that the department is required to create a thorough, documented record of the investigation into their housing discrimination complaint, covering witness contacts, correspondence, and statements. This formal report can serve as an important foundation if the matter proceeds to further administrative or legal proceedings. Tenants who believe relevant evidence was overlooked may find it useful to consult a tenant-rights organization or legal aid provider about whether the report's amendment provision could apply to their situation.
