Operative Text
14-02.5-38. Subpoena enforcement.
The attorney general, on behalf of the department or another party at whose request a
subpoena is issued under this chapter, may enforce the subpoena in appropriate proceedings in
district court.Section 14-02.5-38 of the North Dakota Century Code establishes a mechanism for enforcing subpoenas issued under the state's fair housing chapter. When a subpoena is issued in connection with a fair housing proceeding and a recipient does not comply, the attorney general can step in and seek enforcement through district court. This provision ensures that the subpoena process has legal teeth, allowing courts to compel compliance when necessary.

Under N.D.C.C. § 14-02.5-38, subpoenas issued during fair housing investigations or proceedings carry the weight of potential court enforcement. Property owners and managers who receive a subpoena in connection with a fair housing matter should be aware that the attorney general has authority to pursue district court action if the subpoena is not honored. Compliant operators generally respond to such subpoenas in a timely and complete manner, recognizing that noncompliance can escalate to formal judicial proceedings.

Section 14-02.5-38 provides a meaningful enforcement backstop for parties involved in fair housing proceedings under North Dakota law. If a subpoena is issued on behalf of a complainant or another party and is not followed, the attorney general can seek district court enforcement to compel compliance. Tenants involved in fair housing matters may wish to consult a tenant-rights organization or legal aid provider to understand how this subpoena enforcement mechanism could be relevant to their situation.
