N.D.C.C. §§ 23-10-01 through 23-10-14 § 23-10-07.1
Service fees.
Operative Text
23-10-07.1. Service fees.
Service fees that reasonably reflect the cost of the service provided in a mobile home park,
recreational vehicle park, or campground may be charged. Fees may not be charged unless a
service is actually provided.Section 23-10-07.1 of the North Dakota Century Code governs service fees in mobile home parks, recreational vehicle parks, and campgrounds. Under this provision, operators may charge residents or guests fees for services, but only when those fees reasonably reflect the actual cost of providing the service. Critically, a fee cannot be charged at all unless the corresponding service is genuinely being provided.
Plain English — not legal advice.
Under N.D.C.C. § 23-10-07.1, compliant operators of mobile home parks, recreational vehicle parks, and campgrounds document the actual costs associated with each service they offer and set fees that reasonably correspond to those costs. Operators do not assess fees for services that are not actively being delivered to residents or guests. Maintaining clear records of service costs and fee schedules helps demonstrate compliance with this provision.

Section 23-10-07.1 gives residents and guests of mobile home parks, recreational vehicle parks, and campgrounds the right to be free from fees that exceed the reasonable cost of a service or that are charged for services not actually provided. If you believe you have been charged a fee that violates this provision, general enforcement paths include raising the violation with park management in writing, contacting the North Dakota Department of Health (which oversees mobile home park regulations under Chapter 23-10), or reaching out to a tenant-rights organization familiar with North Dakota law. Keeping records of all fees charged and services received can be useful when pursuing any of these avenues.
