Plain English

Under N.D.C.C. § 23-10.1-02, when North Dakota's relevant state department revokes a mobile home park's license, it has the authority to ask a district court to place that park under the control of a court-appointed receiver. A court may grant that request if it finds the park has committed repeated or serious regulatory violations, or that an ongoing condition poses a serious threat to the health or safety of residents. This provision is a legal mechanism designed to ensure continued oversight of a mobile home park even after its license has been revoked.

For Property Managers

Mobile home park operators subject to license revocation under N.D.C.C. § 23-10.1-02 should be aware that noncompliance with Chapter 23-10 or the department's administrative rules can trigger not only license revocation but also court-supervised receivership. Compliant operators generally maintain ongoing adherence to all applicable health, safety, and regulatory standards to avoid the conditions that would support a petition for receivership. Keeping detailed records of maintenance, inspections, and corrective actions is a practice commonly associated with demonstrating regulatory good standing.

For Tenants

Residents of mobile home parks in North Dakota may find N.D.C.C. § 23-10.1-02 relevant if their park is facing license revocation due to serious or repeated violations, or conditions that threaten health and safety. This provision allows the state department to seek court-appointed receivership, which can provide a layer of oversight and management continuity even when a park's license has been revoked. Tenants who believe their park has serious health or safety issues may consider contacting the North Dakota Department of Environmental Quality or a local tenant-rights organization to understand what reporting or complaint options may be available to them.
