Rent deposits.
Operative Text
(A) Whenever a resident deposits rent with the clerk of a court as provided in section 4781.41 of the Revised Code, the clerk shall give written notice of this fact to the park operator and to the park operator's agent, if any. (B) The clerk shall place all rent deposited with the clerk in a separate rent escrow account in the name of the clerk in a bank or building and loan association domiciled in this state. (C) The clerk shall keep in a separate docket an account of each deposit, with the name and address of the resident, and the name and address of the park operator and of the park operator's agent, if any. (D) For the clerk's costs, the clerk may charge a fee of one per cent of the amount of the rent deposited, which shall be assessed as court costs. (E) All interest that has accrued on the rent deposited by the clerk of a county court under division (B) of this section shall be paid into the treasury of the political subdivision for which the clerk performs the clerk's duties. All interest that has accrued on the rent deposited by the clerk of a municipal court under division (B) of this section shall be paid into the city treasury as defined in division (B) of section 1901.03 of the Revised Code.
Ohio Rev. Code § 4781.42 establishes the administrative procedures that govern what happens after a manufactured-home-park resident deposits rent with a court clerk under the related escrow process. The clerk must notify the park operator (and any agent) in writing, hold the funds in a dedicated escrow account at an in-state bank, and maintain a separate docket tracking each deposit along with the parties' names and addresses. A one-percent administrative fee may be charged as court costs, and any interest earned on the escrowed funds flows to the appropriate government treasury rather than to either party.

Under Ohio Rev. Code § 4781.42, park operators and their agents are entitled to written notice from the court clerk whenever a resident deposits rent into escrow. Compliant operators generally maintain current contact information on file with the court so that notices reach the right person promptly, and they monitor the separate docket the clerk is required to keep. Understanding that escrowed funds are held in a regulated account—and that a one-percent fee is assessed as court costs—helps operators anticipate the procedural posture of any rent-escrow situation.

Ohio Rev. Code § 4781.42 provides residents with procedural protections once rent is deposited with the court clerk: the funds must be held in a dedicated escrow account at an in-state financial institution, and the clerk must keep a formal record of the deposit. Residents should be aware that a one-percent administrative fee may be assessed as court costs against the deposited amount. Tenant-rights organizations familiar with Ohio manufactured-home-park law can help residents understand how these escrow procedures interact with the broader rights established in §§ 4781.36–4781.52.
