Oklahoma Administrative Code § 330:45-1-3 establishes a non-discrimination framework for the State HOPWA Program, which provides housing assistance for persons with HIV/AIDS. Applications must be reviewed and ranked on their merits, and no applicant may be turned away on the basis of protected characteristics such as race, religion, disability, or familial status. Recipients of HOPWA funding are similarly prohibited from discriminating against eligible beneficiaries or in their employment practices, and must certify compliance with federal fair housing laws including the Fair Housing Act and the Civil Rights Act.
Plain English — not legal advice.
Organizations and agencies that receive State HOPWA Program funding under § 330:45-1-3 are expected to maintain written non-discrimination policies covering both service delivery and employment practices. Compliant recipients typically certify to the Oklahoma Housing Finance Agency (OHFA) that they adhere to all applicable fair housing requirements, including those under the Fair Housing Act (42 U.S.C. 3601-19) and the Civil Rights Act. Operators generally document their application review processes to demonstrate that rankings are based on program criteria rather than any protected characteristic.

Eligible beneficiaries seeking housing assistance through the State HOPWA Program are protected under § 330:45-1-3 from being denied services on the basis of race, color, religion, national origin, age, sex, marital or familial status, or disability. If a beneficiary believes a HOPWA recipient has discriminated against them, general enforcement paths include filing a complaint with OHFA, contacting HUD's Office of Fair Housing and Equal Opportunity, or reaching out to a local tenant-rights or fair housing organization. Individuals may also explore protections available under the Fair Housing Act and the Civil Rights Act as referenced in this provision.
