Okla. Stat. tit. 25, §§ 1451–1453, 1501–1508 § 1508
Subpoenas - Witnesses
Operative Text
A. Subpoenas shall issue in proceedings under Section 1101 et seq. of this title as provided in the Oklahoma Administrative Procedures Act. A subpoena so issued shall show on its face the name and address of the party at whose request the subpoena was issued. On petition of the individual to whom the subpoena is directed and notice to the requesting party, the Attorney General may vacate or modify the subpoena. B. Witnesses whose depositions are taken or who are summoned before the Attorney General or employees of the Attorney General's office shall be entitled to the same witness and mileage fees as are paid to witnesses in the courts of the state.
Oklahoma statute 25 O.S. § 1508 governs the use of subpoenas and witness compensation in civil rights proceedings brought under the state's anti-discrimination laws. Subpoenas issued in these proceedings must display the name and address of the requesting party on their face, and the Attorney General has authority to vacate or modify a subpoena if the person served petitions for relief and notifies the requesting party. Witnesses who give depositions or appear before the Attorney General in these matters are entitled to the same fees and mileage reimbursement that Oklahoma courts pay to witnesses in civil proceedings.

Property owners or managers who are parties to proceedings under Oklahoma's anti-discrimination statutes should be aware that under 25 O.S. § 1508, any subpoena issued at their request must identify them by name and address on the face of the document. Compliant operators in these proceedings generally ensure that subpoenas are issued in accordance with the Oklahoma Administrative Procedures Act and that witnesses are compensated at the standard state court rates. Familiarity with the Attorney General's authority to vacate or modify subpoenas is relevant when managing the discovery process in such proceedings.

If you are involved in a civil rights or fair housing proceeding under Oklahoma law, 25 O.S. § 1508 provides important procedural protections regarding subpoenas. If you receive a subpoena in such a proceeding, the statute allows you to petition the Attorney General to vacate or modify it, provided you give notice to the party who requested it. Tenants navigating these proceedings may benefit from consulting a tenant-rights organization or legal aid provider to understand how subpoena challenges and witness fee entitlements under § 1508 may apply to their situation.
