Okla. Stat. tit. 41 § 12
Conveyance of Real Estate Valid without Attornment of Tenant
Operative Text
A conveyance of real estate, or of any interest therein, by landlord, shall be valid without the attornment of the tenant; but the payment of rent by the tenant to the grantor, at any time before notice of sale, given to said tenant, shall be good against the grantee.
Under Oklahoma law at 41 O.S. § 12, when a landlord sells or transfers real property, the sale is legally effective without requiring the tenant to formally acknowledge or consent to the new owner. However, any rent a tenant pays to the original landlord before receiving notice of the sale is considered a valid payment and cannot be reclaimed by the new owner. Once a tenant receives notice of the transfer, rent must be directed to the new owner (grantee).

Under 41 O.S. § 12, property owners and managers who sell or transfer rental property should ensure that tenants receive timely, clear written notice of the ownership change and the identity of the new grantee. Until that notice is delivered, rent payments made by tenants to the prior landlord are legally protected and cannot be treated as unpaid by the new owner. Compliant operators typically document when and how notice was provided to each tenant to establish a clear effective date for the ownership transition.

Under 41 O.S. § 12, tenants are protected when they pay rent to their original landlord before learning of a property sale — those payments are legally valid and cannot be used against them by the new owner. Once a tenant receives notice that the property has been sold or transferred, rent obligations generally shift to the new owner (grantee). Tenants who have questions about whether proper notice was given or how a property transfer affects their tenancy may benefit from consulting a local tenant-rights organization or legal aid office.
