As the Department determines funds to be available, moneys from the Manufactured Dwelling Parks Preservation Fund may be awarded based on the following criteria: (1) Funds must be used to purchase a manufactured dwelling park; (2) An applicant is a community organization or tenant group; (3) The park purchase proposal includes a term of at least 20 years of affordability as defined in the application; (4) The park purchase proposal demonstrates ongoing appropriate technical assistance to the park if cooperative owned or owned by a tenant-owned nonprofit organization; (5) A purchase and sale agreement or other similar document demonstrating site control has been signed by both the buyer and seller of the park; (6) The applicant has adequately demonstrated the ability to meet the proposed terms of loan repayment to a lender or to the Department when funding is awarded as a loan; (7) The applicant has adequately demonstrated the park can be operated in a financially feasible manner for at least the term of affordability; (8) The applicant has agreed to operate the park for the duration of the affordability period as specified in the application: (9) The applicant agrees to meet benchmarks for timely closing on funding resources and completion of renovations as provided in the application proposal; and (10) Any other criteria that the Department or Council determines to be appropriate.
OAR 813 § 813-027-0040 establishes the criteria that govern how Oregon's Manufactured Dwelling Parks Preservation Fund may award money to applicants seeking to purchase a manufactured dwelling park. Eligible applicants must be community organizations or tenant groups, and funded projects must maintain affordability for at least 20 years, demonstrate financial feasibility, and secure site control before funds are awarded. The Oregon Housing and Community Services Department retains discretion to apply additional criteria it or the Council deems appropriate.
Plain English — not legal advice.
While OAR 813 § 813-027-0040 is primarily directed at purchasers of manufactured dwelling parks rather than existing landlords, park owners considering a sale should be aware that prospective buyers using Preservation Fund money must demonstrate site control through a signed purchase and sale agreement and show the capacity to repay any loan and operate the park sustainably. Sellers may be asked to provide documentation supporting the buyer's application, including information about the park's financial operations. Understanding these requirements can help sellers anticipate the due-diligence process when a community organization or tenant group is the prospective buyer.

OAR 813 § 813-027-0040 outlines the criteria under which tenant groups and community organizations can access Oregon's Manufactured Dwelling Parks Preservation Fund to purchase the park where residents live. Residents interested in pursuing a park purchase may benefit from connecting with a tenant-rights organization or housing nonprofit familiar with the application process, as proposals must address affordability commitments, technical assistance plans, and financial feasibility. Tenants can also contact the Oregon Housing and Community Services Department directly to learn whether funds are currently available and what additional criteria may apply.
