OAR 813 § 813-027-0060
Charges
Operative Text
(1) The Department may charge an applicant for an award from the Manufactured Dwelling Parks Preservation Fund for costs incurred by the Department in evaluating and taking action on an application, and may also: (a) Impose a transfer application charge on an owner who receives a contract, grant, loan or tax credit through the Department or who requests the Department's approval of a change in ownership; or (b) Impose a transfer review charge on an owner and transferee who effects a change in ownership without prior written approval by the Department. (2) The Department may charge for costs incurred by the Department for review of a transaction by the Department of Justice, including but not limited to a change requested by the applicant to a required document.
Oregon Administrative Rule OAR 813 § 813-027-0060 establishes the Oregon Housing and Community Services Department's authority to recover costs associated with reviewing applications and ownership changes related to the Manufactured Dwelling Parks Preservation Fund. Owners who transfer ownership with prior departmental approval may face a transfer application charge, while those who complete a change in ownership without that prior written approval may face a separate transfer review charge. The Department may also pass along costs incurred when the Department of Justice reviews a transaction, including costs triggered by applicant-requested changes to required documents.

Under OAR 813 § 813-027-0060, property owners and operators involved with the Manufactured Dwelling Parks Preservation Fund generally seek the Department's prior written approval before completing any change in ownership, since doing so without approval can trigger a transfer review charge in addition to the standard transfer application charge. Compliant operators typically budget for potential cost-recovery charges at the application stage and during any ownership transition, including possible Department of Justice review fees. Keeping documentation of all departmental communications and approvals related to ownership changes is a practice consistent with the requirements outlined in this rule.

OAR 813 § 813-027-0060 governs how the Oregon Housing and Community Services Department charges owners and applicants in connection with the Manufactured Dwelling Parks Preservation Fund, which exists in part to support the preservation of manufactured dwelling park communities where tenants reside. While this provision primarily addresses charges imposed on owners and applicants rather than tenants directly, residents of manufactured dwelling parks may have an interest in understanding how ownership changes in their community are reviewed and approved. Tenants who have questions about ownership transitions affecting their park can reach out to tenant-rights organizations or consult publicly available resources from the Oregon Housing and Community Services Department for general information.
