OAR 813 § 813-261-0040
Use of Funds
Operative Text
(1) Use of ORE-DAP funds must be in compliance with ORE-DAP requirements as specified in the Program Guidance.. (2) To the extent of available funding, eligible ORE-DAP services include: administration, financial assistance, and program delivery. Examples of allowable services and activities within these categories are described in detail in the program guidance. (3) ORE-DAP funds must be used to supplement existing funds, to support existing programs, or to establish new programs. Organizations or entities receiving ORE-DAP funds shall not use ORE-DAP funds to replace funds currently being received from other available sources or sources reasonably expected to be available.
OAR 813 § 813-261-0040 governs how Oregon Rental Eviction and Diversion Assistance Program (ORE-DAP) funds may be spent. Eligible uses fall into three broad categories—administration, financial assistance, and program delivery—with specific allowable activities detailed in the Program Guidance. Critically, these funds are intended to supplement or expand housing assistance efforts, not to substitute for other funding sources that an organization already receives or reasonably expects to receive.
Plain English — not legal advice.
Property owners and managers are generally not the direct recipients of ORE-DAP funds under OAR 813 § 813-261-0040; rather, administering organizations channel those funds toward eligible services. Compliant operators who participate in ORE-DAP programs typically ensure that any assistance received is applied within the categories of administration, financial assistance, or program delivery as defined in the Program Guidance. Understanding these use restrictions can help property owners set appropriate expectations when working with ORE-DAP-funded organizations on rental assistance arrangements.

OAR 813 § 813-261-0040 shapes how organizations that receive ORE-DAP funds are permitted to deploy those resources, which in turn affects the types of assistance available to renters facing eviction or housing instability. Tenants seeking help can ask participating organizations whether the services offered—such as financial assistance—fall within the allowable categories described in the Program Guidance. Tenant-rights organizations and local housing agencies can help renters understand what ORE-DAP-funded programs may be available in their area.
