ORS § 90 § 90.318
Criteria for landlord provision of certain recycling services.
Operative Text
(1) In a city or the county within the urban growth boundary of a city that has implemented multifamily recycling service, a landlord who has five or more residential dwelling units on a single premises or five or more manufactured dwellings in a single facility shall at all times during tenancy provide to all tenants: (a) A separate location for containers or depots for materials designated for recycling collection on the uniform statewide collection list established under ORS 459A.914, adequate to hold the reasonably anticipated volume of each material; (b) Regular collection service of the source separated recyclable materials; and (c) Notice at least once a year of the opportunity to recycle with a description of the location of the containers or depots on the premises and information about how to recycle. New tenants shall be notified of the opportunity to recycle at the time of entering into a rental agreement. (2) As used in this section, “recyclable material” and “source separate” have the meaning given those terms in ORS 459.005.
Oregon Revised Statutes § 90.318 requires landlords operating five or more residential dwelling units or manufactured dwellings on a single premises within a city or urban growth boundary that has implemented multifamily recycling service to maintain recycling infrastructure for tenants at all times. This includes providing designated container locations sized for anticipated recycling volumes, arranging regular collection of source-separated recyclables, and delivering recycling notices to tenants at least annually. New tenants must receive recycling information at the time their rental agreement is signed.
Plain English — not legal advice.
Under ORS § 90.318, operators of qualifying multifamily properties—five or more units or manufactured dwellings on a single premises within an applicable urban growth boundary—are generally expected to maintain dedicated recycling container locations, coordinate regular collection service for source-separated materials, and issue annual recycling notices to all current tenants. Compliant operators also provide recycling information to new tenants at lease signing rather than waiting for the annual notice cycle. Keeping records of notices sent and collection service agreements can help demonstrate ongoing compliance with the provision's requirements.

ORS § 90.318 gives tenants in qualifying multifamily properties the right to access recycling containers, regular collection service, and at least annual written notice about recycling opportunities, including container locations and instructions. New tenants are entitled to this information at the time they enter into a rental agreement. Tenants who believe these services are not being provided may consider contacting their local city or county solid waste or housing authority, or reaching out to a tenant-rights organization to understand available options.
