ORS § 90 § 90.582
Publication of submeter or pro rata bills; tenant inspection.
Operative Text
(1) If a landlord bills tenants for water using pro rata billing or submeter billing, the landlord shall post the facility water bills in an area accessible to tenants, including on an Internet location. (2) A landlord shall, upon written request by the tenant, make available for inspection by the tenant all utility billing records relating to a utility or service charge billed to the tenant by the landlord during the preceding year. The landlord shall make the records available to the tenant during normal business hours at an on-site manager’s office or at a location agreed to by the landlord and tenant. A tenant may not abuse the right to inspect utility or service charge records or use the right to harass the landlord. (3) If a landlord fails to comply with a provision of ORS 90.560 to 90.584, the tenant may recover from the landlord the greater of: (a) One month’s rent; or (b) Twice the tenant’s actual damages, including any amount wrongfully charged to the tenant.
ORS § 90.582 establishes transparency requirements when landlords charge tenants for water through pro rata or submeter billing. Landlords must post facility-wide water bills in a place tenants can access, including online, and must make up to one year of utility billing records available for tenant inspection upon written request. If a landlord fails to comply with these or related requirements under ORS 90.560 to 90.584, the tenant may recover the greater of one month's rent or twice their actual damages, including any amounts wrongfully charged.
Plain English — not legal advice.
Under ORS § 90.582, operators who use pro rata or submeter water billing generally maintain a current posting of facility water bills in a common area accessible to all tenants and on an internet location. When a tenant submits a written inspection request, compliant operators make the relevant utility billing records for the preceding year available during normal business hours at an on-site manager's office or another mutually agreed location. Keeping organized billing records and a reliable posting system helps operators meet the disclosure standards set out in ORS 90.560 to 90.584.

ORS § 90.582 gives tenants the right to see the facility-wide water bills their landlord relies on for pro rata or submeter charges, which must be posted in an accessible location including online. By submitting a written request, tenants can also inspect up to one year of utility billing records at the manager's office or another agreed location during normal business hours. If a landlord does not comply with ORS § 90.582 or the broader requirements of ORS 90.560 to 90.584, tenants may be entitled to recover the greater of one month's rent or twice their actual damages; tenant-rights organizations or a licensed Oregon attorney can help clarify what options may be available.
