ORS § 90 § 90.655
Park closure notice to nontenants; report of tenant reactions.
Operative Text
(1) A landlord that gives a notice of termination under ORS 90.645 shall, at the same time, send one copy of the notice to the Housing and Community Services Department by first class mail. The landlord shall, at the same time, send a copy of the notice, both by first class mail and by certified mail with return receipt requested, for each affected manufactured dwelling, to any person: (a) That is not a tenant; and (b)(A) That the landlord actually knows to be an owner of the manufactured dwelling; or (B) That has a lien recorded in the title or ownership document records for the manufactured dwelling. (2) A landlord that terminates rental agreements for manufactured dwelling park spaces under ORS 90.645 shall, no later than 60 days after the manufactured dwelling park or portion of the park closes, report to the department: (a) The number of dwelling unit owners who moved their dwelling units out of the park; and (b) The number of dwelling unit owners who abandoned their dwelling units at the park.
ORS § 90.655 establishes notification and reporting duties that accompany a manufactured dwelling park closure notice issued under ORS 90.645. When a landlord issues such a termination notice, copies must simultaneously go to the Oregon Housing and Community Services Department by first-class mail, and to any non-tenant owner of an affected manufactured dwelling or any lienholder of record — by both first-class and certified mail with return receipt. After the park or affected portion closes, the landlord has up to 60 days to report back to the department on how many dwelling owners relocated their units and how many abandoned them.
Plain English — not legal advice.
Operators initiating a park closure under ORS 90.645 generally ensure that the termination notice is sent simultaneously to the Oregon Housing and Community Services Department, to any non-tenant dwelling owners, and to any recorded lienholders — using the specific mail methods required by ORS § 90.655. Certified mail with return receipt is required for the non-tenant and lienholder copies, so compliant operators typically retain those receipts as documentation. Within 60 days of the park's closure, operators also submit the required report to the department detailing how many dwelling owners relocated versus abandoned their units.

ORS § 90.655 is primarily directed at landlords and non-tenant stakeholders, but tenants in a manufactured dwelling park facing closure under ORS 90.645 can be aware that the law requires the landlord to notify the Oregon Housing and Community Services Department at the same time closure notices are issued. This means the department receives a copy of the notice and collects follow-up data on what happens to residents, which can be a resource for tenants seeking information about their situation. Tenants who believe these notice requirements have not been followed may wish to consult a tenant-rights organization or legal aid provider familiar with Oregon manufactured dwelling park law.
