Plain English

Oregon Revised Statutes § 90.660 places two limits on local government authority over manufactured dwelling park closures. First, any local ordinance, rule, or other local law on this subject that was adopted on or after July 1, 2007, or amended on or after January 1, 2010, cannot be enforced by that local government. Second, even older local laws that remain valid cannot be applied in a way that reduces the rights that park tenants already hold under ORS 90.645 or 90.655, the state statutes governing closure notices and relocation assistance.

For Property Managers

Operators of manufactured dwelling parks in Oregon should be aware that under ORS § 90.660, state law sets a floor for tenant rights during park closures or partial closures. Compliant park operators generally look to ORS 90.645 and 90.655 as the governing framework for closure procedures, rather than relying on local ordinances that may be unenforceable under this provision. When local rules appear to conflict with or fall short of state standards, operators typically apply the state requirements to ensure compliance.

For Tenants

Under ORS § 90.660, tenants in manufactured dwelling parks have a state-law guarantee that local governments cannot use newer local ordinances—those adopted after July 1, 2007, or amended after January 1, 2010—to govern park closure procedures. Equally important, no local law, regardless of its age, can be used to strip away the rights that tenants hold under ORS 90.645 or 90.655, such as notice and relocation assistance protections. Tenants who believe a local government or park owner is applying an impermissible local rule may consider consulting a tenant-rights organization or legal aid provider familiar with Oregon manufactured housing law.
